1. Purpose and scope
These Terms of Use govern access to rushops.netlify.app and apply at a general level to software, applications, products and services made available under the RushOps name. RushOps is the trade name used by Noé Durand, an individual entrepreneur established in France.
Product-specific terms or notices may supplement these Terms. If a product-specific document conflicts with these Terms, the more specific document applies to that product to the extent of the conflict.
2. Acceptance of the Terms
By accessing or using the website or a RushOps service, you agree to comply with these Terms. If you do not agree, you should not use the relevant website or service.
3. Access and accounts
The main RushOps website is publicly accessible and does not currently provide user accounts. Certain separate RushOps services may require an account. Where an account is provided, users must give accurate information, keep their credentials confidential and promptly report suspected unauthorised access.
Access may be restricted or suspended where reasonably necessary to protect users, RushOps, third parties or the security and proper operation of a service, or where these Terms or applicable law are breached.
4. RushOps software and services
RushOps develops and operates digital products that may evolve over time. Descriptions on the website are provided for general information and do not create a commitment that every feature will remain available or unchanged.
Aviation-related services
Unless expressly stated otherwise for a particular product, RushOps aviation-related software is an information and assistance tool. It does not replace official aeronautical information, approved documentation, applicable regulations, operational procedures, or required pre-flight and in-flight checks.
Users must verify relevant information against appropriate official and current sources. Aviation decisions remain the responsibility of the pilot or operator, as applicable. RushOps services must not be relied upon exclusively where doing so would be unsafe or contrary to applicable regulations.
5. User responsibilities
Users are responsible for using RushOps services lawfully, for checking that a service is suitable for their intended use, and for maintaining an appropriate device, browser and internet connection. Users remain responsible for decisions made on the basis of information presented by a service.
6. Acceptable use
You must not use the website or RushOps services to:
- violate applicable law or the rights of another person;
- seek unauthorised access to accounts, systems, data or restricted areas;
- circumvent, test or compromise security without prior written authorisation;
- introduce malicious code or interfere with the operation of a service;
- send abusive automated requests or place an unreasonable load on infrastructure;
- copy, extract, redistribute or exploit protected material without authorisation; or
- misuse a service in a way that may harm RushOps, its users or third parties.
7. Intellectual property
RushOps website content, original software, branding, logos, interfaces, graphics and documentation are protected by applicable intellectual-property laws where applicable. These Terms do not transfer ownership or grant a licence beyond the limited right to access and use a service for its intended purpose.
Third-party names, trademarks, software, libraries, services, data and content remain the property of their respective owners and may be subject to separate terms.
8. Third-party services and links
RushOps services may contain links to or rely on third-party services. RushOps does not control third-party websites or services and is not responsible for their content, availability or independent practices. Users should review the terms and privacy information supplied by the relevant third party.
9. Availability, changes and disclaimers
RushOps may maintain, update, change, suspend or discontinue all or part of a website or service. Reasonable efforts may be made to preserve continuity, but uninterrupted, error-free or permanently available access is not guaranteed.
Information and services are provided with reasonable care. To the extent permitted by applicable law, RushOps is not liable for indirect or unforeseeable loss, or for loss resulting from misuse, unauthorised modification, a user's failure to perform required checks, or a third-party service outside RushOps' control.
Nothing in these Terms excludes or limits liability, remedies or mandatory rights where exclusion or limitation is prohibited by French or EU law.
10. Changes to these Terms
These Terms may be updated to reflect changes to RushOps services, legal requirements or operating practices. The updated version will be published on this page with a revised effective date. Where appropriate, additional notice may be provided within the relevant service.
11. Governing law
These Terms are governed by French law. This choice does not deprive consumers of mandatory protections available under the law that would otherwise apply to them. Any dispute should first be raised with RushOps in an effort to reach an amicable solution; access to competent courts and mandatory consumer remedies remains unaffected.
